What Happens Immediately After a Positive or Refusal Test?

- Removal from duty: You are removed from safety-sensitive duties right away.
- SAP referral: Your employer must provide a list of DOT qualified SAPs for you to begin the evaluation process under 49 CFR 40.287.
The Return-to-Duty (RTD) Process
To regain safety-sensitive privileges, here’s a typical sequence:
- SAP evaluation: A certified Substance Abuse Professional determines your needs and creates a customized plan.
- Treatment or education: You must complete the SAP-recommended steps which could include counseling, classes, or in-patient treatment as required.
- Return-to-duty test: After completing the plan, you must pass a DOT drug or alcohol test.
- Follow-up testing is required:
- Minimum of 6 unannounced tests in the first 12 months.
- Possibly extended to up to 60 months (5 years), depending on SAP recommendations.
Employer Discretion & Consequences
Even with RTD completion, employment isn’t guaranteed. Some carriers maintain zero‑tolerance and may decline to rehire you.
Impact on Your CDL & Recordkeeping
- Clearinghouse entry: All violations including positive results, refusals, RTD steps -are logged in the FMCSA Clearinghouse and remain for up to 5 years or until RTD completion.
- License suspension: Under the Clearinghouse II rule (effective Nov 18, 2024), state DMVs may downgrade or suspend your CDL if you’re flagged as ‘prohibited’.
- DAC history and job search: Many carriers check DAC and Clearinghouse records. Even post‑compliance, being listed can limit your job opportunities.

Most carriers enforce these regulations strictly. Zero tolerance means testing positive or refusing usually triggers a removal and RTD requirement.

- Pass the return-to-duty test and comply with all follow-up testing.
- Check your Clearinghouse status and verify with your employer or SAP that it’s updated.
- Before reapplying, confirm whether prospective carriers accept RTD participants or enforce zero-tolerance.
Getting Back to Work
If you are terminated after a positive test, you can re-apply or search for a new employer that provides second chances to drivers who have been terminated and undergone the RTD process.
Failing or refusing a DOT drug or alcohol test does not mean automatic termination, but it does mean you’re immediately removed from safety-sensitive responsibilities. The only way to get back is via the SAP-controlled return-to-duty process, which involves evaluation, treatment, testing, and long-term follow-up.
